Carsbay Terms & Conditions

1. Introduction

By accessing or using Carsbay, you agree to comply with and be bound by these Terms & Conditions. Carsbay operates as an online platform for pre-owned vehicle auctions and related automotive services in the United Arab Emirates.

2. User Eligibility

• You must be at least 18 years old to create an account or participate in auctions.
• You must provide true, complete, and accurate information during registration.
• Carsbay may suspend, restrict, or terminate accounts that provide false or misleading information.

3. Auction Rules

• All bids placed on Carsbay are legally binding.
• Bids cannot be withdrawn once submitted.
• Carsbay may apply anti-sniping extensions when bids are placed near the auction end time.
• The highest valid bidder at the close of the auction is considered the winning bidder.
• Carsbay reserves the right to cancel, pause, extend, or suspend any auction if required.

4. Winning & Payment Obligations

• Winning bidders must complete payment within the time specified by Carsbay.
• Failure to complete payment may result in penalties, account suspension, or deposit forfeiture.
• Vehicles are sold on an “as-is” basis unless otherwise stated in writing.
• Carsbay may apply additional charges, fees, taxes, or administrative costs where applicable.

5. Deposit Policy

• A deposit may be required before a user is approved to access live pricing or place bids.
• The deposit is intended to confirm buyer seriousness and platform eligibility.
• Carsbay may apply deposit balances toward final settlement, invoice amounts, or auction obligations.

6. Deposit Forfeiture & Refunds

• If a winning bidder fails to complete payment on time, Carsbay may forfeit some or all of the deposit.
• Carsbay may also freeze or restrict the account of a defaulting user.
• Deposits may be refundable only where the user has no active unpaid obligations, defaults, or policy violations.
• Refund processing times may vary depending on internal review and payment method.

7. Vehicle Information

• Vehicle descriptions, mileage, specifications, and damage notes are provided for general information only.
• Carsbay does not guarantee that all listing details are complete, error-free, or independently verified.
• Buyers are responsible for conducting their own review, inspection, and due diligence before bidding.

8. Privacy Policy

• Carsbay collects user information required to operate accounts, verify users, process deposits, and manage auctions.
• User data is stored securely and is not sold to third parties.
• Carsbay may use collected information to improve services, ensure platform safety, and comply with legal obligations.
• Carsbay may disclose information where required by law, regulation, or lawful authority.

9. Limitation of Liability

Carsbay shall not be liable for listing inaccuracies, bidding decisions, technical interruptions, auction delays, payment delays, or indirect losses resulting from platform usage, except where required by law.

10. Modifications

Carsbay reserves the right to modify these Terms & Conditions at any time. Continued use of the platform after changes are published constitutes acceptance of the updated terms.

11. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.
